  • Qualified Intermediary: You cannot take possession of the proceeds from the sale of your property. Instead, a qualified intermediary must hold the funds until they are used for the purchase of the new property.


  • Equal or Greater Value: To fully defer taxes, the new property must be of equal or greater value than the property you sold. If you buy a property of lesser value, the difference (known as "boot") may be subject to taxes.


Types of 1031 Exchanges


  • Delayed Exchange: The most common type, where you sell your property first and then buy a replacement property within the required timeline.


  • Simultaneous Exchange: This is when the sale of your old property and the purchase of the new property happen on the same day.


  • Reverse Exchange: In this case, you purchase the replacement property before selling your old property. This option requires careful planning and should be approached with the help of professionals.
